Terms and conditions

§1 Scope of Application

The present General Terms and Conditions apply to all contracts concluded with Landgasthof Hotel Linde.

§ 2 Conclusion of Contract, Contracting Parties

1. The contract is concluded between the customer and the Landgasthof as soon as the reservation has been confirmed in writing by the Landgasthof. The conclusion of the contract obliges both contracting parties to fulfill it. Option dates are binding for both contracting parties.

2. Option dates are binding for both contracting parties. If the agreed option date is exceeded and the reservation is not confirmed in writing, Landgasthof Hotel Linde reserves the right to cancel the option and rent the rooms to other parties.

§ 3 Services, Prices, Payments, Complaints

1. The customer is obliged to pay for the services used by them or the agreed prices of the Landgasthof. This also applies to services and expenses incurred by the Landgasthof to third parties at the customer’s request.

2. Reserved rooms are available to the client only for the time agreed in writing. Any use of the rooms beyond the agreed period requires prior approval by the management of the Landgasthof and may be charged.

3. All prices are in euros and include statutory value-added tax. If the period between the conclusion of the contract and the provision of services exceeds 120 days, Landgasthof Hotel Linde reserves the right to make price or service changes.

4. Invoices are payable without deduction within 30 days from the invoice date. After this period, customary bank default interest will be charged.

5. The Landgasthof is entitled to request an appropriate advance payment or security deposit upon conclusion of the contract or thereafter.

6. Complaints regarding obvious defects can only be considered if they are reported immediately upon provision of the service.

7. Delivered goods remain the property of the seller until all claims arising from the business relationship between seller and buyer have been paid in full.

§ 4 Cancellation by the Customer

1. Withdrawal by the customer from the contract concluded with the Landgasthof requires the written consent of the Landgasthof. If such consent is not given, the agreed contract price must be paid even if the customer does not make use of the contractual services.

2. Free cancellation of the event is possible up to two months before the start of the event after conclusion of a legally binding contract.

In the event of cancellation after this deadline, the following cancellation fees will be charged for the booked arrangements:

  • up to 2 months before the start of the event: free of charge
  • up to 30 days before the start of the event: 20% of the booked services
  • up to 15 days before the start of the event: 50% of the booked services
  • up to 2 days before the start of the event: 80% of the booked services
  • from 2 days before the start of the event: 100% of the booked services

The Landgasthof reserves the right to additionally claim any further damages incurred.

§ 5 Binding Number of Participants

1. Banquet events: The final number of participants (divided into adults aged 12 and over, children under 12 years, and toddlers under 3 years) must be reported to the Landgasthof no later than 2 days before the event. After this deadline, the ordered number of persons will be charged.

2. Conference events: The final number of participants must be reported to the Landgasthof no later than 2 days before the event. The number of participants reported at this time will be charged to the booker; absences due to illness can no longer be taken into account. Even in the event that the participants bear the conference package themselves, absences will be charged to the booker. If fewer than 20 persons participate in the conference or the registered number of participants falls below 20, a room rental fee of €100.00 per day will be charged. If a larger room is required than would be sufficient for the number of participants, the full room rental for that room will be charged.
The optimal room allocation is at the discretion of the Landgasthof, unless a written agreement has been made in advance.

§6 Special Notes for Events

1. The ordering party and the organizer are liable for payment of any food and beverages additionally ordered by the event participants. For unpaid invoices of event participants, the organizer / ordering party is automatically liable, even if this was rejected in advance. If the ordering party is not simultaneously the organizer, both are jointly and severally liable.

2. The customer is fully liable to the Landgasthof for damages caused by themselves or their guests. The conclusion of any necessary insurance for exhibition, seminar, conference items or technical equipment brought along is the responsibility of the customer. The Landgasthof is not liable for lost, damaged, or destroyed items. The Landgasthof may request proof of such insurance.

3. If the Landgasthof procures third-party services, technical or other facilities for the customer, it acts in the name and for the account of the customer. The customer is liable for careful handling and proper return of these facilities and indemnifies the Landgasthof against all third-party claims arising from the provision of these facilities.

4. Newspaper advertisements, invitations to job interviews or sales events generally require prior written consent of the Landgasthof. If significant interests of the Landgasthof are impaired as a result, the Landgasthof may withdraw from the contract and cancel the event.

5. To prevent damage to ceilings and walls, the attachment of decorative materials or other objects must be coordinated with the Landgasthof in advance. The customer warrants that decorative materials in particular comply with fire safety regulations. The Landgasthof may request submission of a corresponding certificate from the competent fire protection authority.

6. No food or beverages brought in by guests may be consumed throughout Landgasthof Hotel Linde and its associated outdoor areas. Exceptions must be agreed in writing with Landgasthof Hotel Linde (place setting fee / corkage fee).

7. The Landgasthof assumes no liability for food brought in, as the HACCP cooling chain cannot be monitored by us. Food and beverages that remain (especially at buffets) may not be taken home.

8. The event room is available to the organizer / ordering party exclusively on the day of the event when booked. Any setup on the previous day or dismantling on the day after the event is only possible by prior arrangement and cannot be guaranteed. Fees may be charged for use of the rooms outside the event times.

9. Please note that the volume must be reduced or adjusted from 11:00 p.m. From 12:00 a.m., a nightly surcharge of €250.00 per hour applies. Any booked packages remain valid.

§ 7 Withdrawal by the Landgasthof

The Landgasthof is entitled to withdraw extraordinarily from the contract for objectively justified reasons, for example if

1. force majeure or other circumstances not attributable to the Landgasthof make fulfillment of the contract impossible;

2. rooms are booked under misleading or false information of essential facts, e.g. regarding the person of the customer or the purpose;

3. the Landgasthof has reasonable grounds to assume that the event may jeopardize the smooth operation, security, or public reputation of the Landgasthof, without this being attributable to the sphere of control or organization of the Landgasthof;

4. the organizer conceals the fact that they are a political association; In the event of justified withdrawal by the Landgasthof from the contract, the customer has no claim for damages.

§ 8 Official Permits

1. Any required official permit must be obtained by the organizer at their own expense, unless expressly agreed otherwise in writing. The organizer is responsible for compliance with all relevant regulatory requirements. Upon request by the Landgasthof, appropriate proof must be provided.

2. The ignition of fireworks or firecrackers is generally not permitted. Exceptions must be agreed in writing in advance and approved by the District Office of Günzburg. In the event of any claims or lawsuits, the organizer or the client will be held liable. The use of open flames (spark fountains, sparklers, fireworks) in the premises is not permitted. Exceptions are table candles and tea lights.

3. All music events must be reported in advance by the organizer to GEMA. The organizer bears the GEMA fees. The Landgasthof is indemnified by the organizer against any claims by GEMA arising from unauthorized use of GEMA rights or third-party rights (e.g. due to failure to register by the organizer).

§ 9 Lost Property

No liability is assumed for lost property or items left behind / forgotten. These will only be returned upon request and against reimbursement of costs. The Landgasthof will store the items for a period of 6 months. Thereafter, the items will be handed over to the local lost property office if they have an apparent value.

§ 10 Overnight Stays at the Eurohotel

1. See the terms and conditions of the Eurohotel.

2. The Landgasthof is not liable for damages or other unlawful behavior of the conference guest.

3. The conference guest staying at the Eurohotel pays their hotel bill directly to the Eurohotel.

§ 11 Final Provisions

1. Should one or more provisions of these terms and conditions be invalid, this shall not affect the validity of the remaining provisions.

2. Amendments or additions to the contract, the acceptance of the offer, or ancillary agreements must be made in writing to be effective. In addition, the statutory provisions apply.

3. Place of performance and payment is the registered office of the Landgasthof in Günzburg. Exclusive place of jurisdiction – also for disputes relating to checks and bills of exchange – in commercial transactions is the registered office of the Landgasthof.

4. These terms and conditions are an integral part of the event contract. The event agreement and these terms and conditions together constitute the event contract.

 

5. German law shall apply.
